１．本規約について
当社が販売するHome Media Serverテレパソとは、当社が、お客様に対し、Home Media Serverであるテレパソを販売する、当社の販売事業の名Home Media Server称です。お客様が、テレパソを購入し、使用するにあたっては、Home Media Server利用規約（本規約）の内容をご理解の上、ご承諾いただくことにな ります。Home Media Serverをご購入されたお客様は、本規約にご同意いただいたものと認めることになります。
２．機器に備わる機能
Home Media Serverの目的物であるテレパソ（以下「機器」という）には、インターネット接続によりリモート操作が可能な機能と、インターネット接続により、離れた場所から遠隔アクセスソフトを利用して録画したデータをみる機能と、インターネット接続により離れた場所から遠隔操作により録画予約をする機能と、が備わってい ます。 DNSサーバーの運用、録画予約の為のデーターベース、番組スケジュール、Plexでの認証は、第３者のサービスを 利用しお客様個人がご家庭に配置したHome Media Serverよりアクセスされるものです。 万一これらのサーバーに障害が起こった場合は、その復旧をそれぞれのサービスに 依存し弊社では一切関与できませんのでご了承ください。 これらのサービス不継続により生じる一切の責任は弊社にはございません。弊社では、著作権の問題より番組データー、番組予約による データーベース等の運用およびHome Media Serverの運行は一切関与 しておりません。（これらの機能は、付加価値サービスとなり販売価格にこれらのサービスの提供は一切含んでおりません）個人が個人の自宅よりネットワークを介して視聴、録画、ダウンロードして楽しむことは法律で認められております。 お客様は、機器をご利用いただくにあたって、地上波受信エリア、アクセス可能なネットワークのサービスエリア、および機器の定める仕様の範囲 でのみ使用可能であることに同意していただきます。受信する地上波の質に関しては、お客様の受信状況に変わってくるものであり、その画質を保 証するものではありません。また、回線の速度によるダウンロード速度においてはこちらでは一切関与いたしません。
３．機器の操作
設置完了後の機器の操作は、いかなる場合も、全てお客様ご自身が行うものですから、当社は、お客様がご購入した機器の操作には、一切関与いたしません。ただ し、ソフトウェアーのアップグレードや機器にインストールされているソフトウェアーの不具合の修正などにかかわる際は、当社のシステム管理者または自動修 正プログラム機能が直接お客様の機器にアクセスして修正することがございます。 いかなる場合も機器へのシステム管理者権限はWatchJTVにあるものとします。管理者は機器以外の操作に関しましては一切関与いたしません。
テレパソ運用上必要な定期的なメインテナンスはシステムモニタリング（有料）ご利用のメンバーのみのサービスとなります。
４．責任の範囲
お客様が機器を使用して行う全ての行為（録画予約、録画及び録画したデータの送信等）につき、当社は何ら関与せず、一切の責任を負いません。当社は、お客様の申し出により機器の修理・交換をする場合でも、保存されていたデータの救済、移動、保管などの行為は一切いたしません。機器の設置、維持、管理 及び録画したデータの管理は、お客様が自己の責任の下で行うものとし、これらに関し当社はいかなる責任も負いません。また、天災、事変、気象等の障害 その他当社の責めに帰すことのできない事由により、機器の使用が不可能ないし困難となった場合も、当社は一切の責任を負いません。機器の保証期間はご購入 されてから3ヶ月間となります。すべての保証はメーカーの保証に基づきます。尚、システムの不具合に関する修理、交換の際の送料はお客様のご負担となりま す。
当社はHome Media Serverテレパソ機器を以外の設定に関する責任は当社では一切関与いたしません。インターネットの回線、電波受信状況、ご家庭内のLAN環境などには一切関与いたしません。
５．禁止事項ほか
契約者は、本サービスの利用にあたり、以下の行為を行わないものとします。
１）当社又は第三者の財産権（知的財産権を含みます。）、プライバシー、名誉、その他の権利を侵害する行為。
２）本サービスを違法な目的で利用する行為。
３）第三者になりすまして本サービスを利用する行為。
４）本サービス及びその他当社の事業運営に支障をきたすおそれのある行為。
５）法令、本規約若しくは公序良俗に反する行為、当社若しくは第三者の信用を毀損する行為、及び当社若しくは第三者に不利益を与える行為。
機器の保障：
お客様は、機器に関して、通常の使用方法に従って機器を使用する以外の一切の行為をすることはできません。お客様において機器を修繕、改良された場合は、こ ちらではそれ以降のサポートは一切行いません。お客様の故意又は過失により機器が破損又は紛失した場合には、保証期間内であれば有料にて修理いたしますが、保証期間外の場合は別途修理料金を頂戴いたします。いかなる理由でも機器の蓋を開いた場合には、保証の対象外となります。
６．設置場所について
お客様には、機器をコンピュータシステムのお取扱いを頂くこととし、テレビ或いはビデオデッキの上等の不安定な場所・発熱のある機器の近く、及び振動・埃・ 湿気を避けて、風通しの良い状態で設置いただくものとします。天候により気温があがるとCPUの温度も加熱するため、内蔵のFANがCPUを冷やそうとす る為ファンがフル回転することがございます。いかなる設置条件でも設置の際はお客様の判断によって行っていただくものとします。さらに、機器を第３者へ貸 与はする場合は、お客様の責任をもって行ってください。当社では一切責任を負いません。
７．補償範囲
本規約の条項に関係なく、いかなる理由においてもお客様が機器を使用した結果として起きた損害に対して、当社はお客様に対する責任を負わないことをお客様に同意していただきます。お客様に対する当社の責任は、機器の交換、ソフトウェアーの維持にとどまります。
８．プライバシーについて
当社は保有する購入者の氏名および住所を特定する情報（以下「購入者情報」といいます）を次に掲げる場合を除き、第３者にみだりに開示しません。
(1) 業務を行う上で必要な場合
(2) 業務向上を目的とした利用者調査を行う場合
(3) 利用者が書面等により合意した場合
(4) 法令の規定により提供が認められている場合その他公共の利益のために必要がある場合
当社は利用者調査、その他、当社の業務向上を目的として、加入者情報を自ら使用し、または第３者に使用させることができます。第３者に利用情報の使用を許す場合には秘密保持契約等適切な契約を締結します。
９．ＮＨＫ放送受信について
機器を使用して、お客様が日本放送協会（ＮＨＫ）の放送を受信する場合には、お客様と日本放送協会との間で個別に、日本放送協会の行なう放送の受信について の契約をしていただく必要があります。お客様と日本放送協会（ＮＨＫ）間のご契約に関して、当社は一切の関与をいたしません。
10．契約の方式、準拠法、専属的合意管轄
Home Media Serverテレパソのご購入には、本規約に同意していただく必要がございます。Home Media Serverテレパソの契約に関連する一切の文 書は、アメリカ合衆国の法令及び商慣習にのみ準拠して解釈されるものとします。機器に関連して裁判の必要が生じた場合は、アメリカカリフォルニア州の法律 に基づきます。
11．プロキシー／VPNサーバーとしてのご利用について
Home Media Serverテレパソにはオプションにてプロキシーサーバー機能を搭載しております。アクセス先につきましては、弊社では一切関与いたしません ので、お客様個人の責任の下ご利用頂くものとします。アクセス先についてのお問い合わせには応じることができません。このオプションサービスにつきまして は、アクセス先の動作を保障するものではございませんのでご了承ください。VPN接続はインターネット接続そのものを提供するサービスではございません。事前に接続環境をご用意ください。 弊社VPNサーバーを経由して接続する場合、実効速度はご利用のプロバイダやVPNサーバーのトラフィック状況により減衰いたします。テレパソVPNサーバーを経由して接続する場合、実効速度はテレパソ設置場所のプロバイダやのトラフィック状況により減衰いたします。
サービス内容／変更について
当社は、会員への事前の通知なくして、本サービスの諸条件、運用規則、または本サービスの内容を変更することがあり、会員は、これを承認します。この変更には、価格の変更および本サービスの内容の部分的な改廃などを含みますが、これらに限定されません。また、当社は予告なしに、本サービスを停止することができます。この変更、停止などについては、本サービスのオンラインまたは当社が提供する手段を通じ、発表するものとします。
当社は次に該当する場合には、会員に連絡することなく、一時的にサービスを中断する場合があります。
（1）本サービスのシステムの保守を定期的に、または緊急に行う場合
（2）火災、停電などにより本サービスの提供ができなくなった場合
（3）地震、噴火、洪水、津波などの天災により本サービスの提供ができなくなった場合
（4）戦争、変乱、暴動、騒乱、労働争議、お住いの国による規制などにより本サービスの提供ができなくなった場合
（5）その他、運用上、技術上会社が本サービスの一時的な中断を必要と判断した場合
本サービスの内容は、当社がその時点で提供可能なものとします。当社は提供する情報、会員が登録する文章およびソフトウエアなどについて、その完全性、正確性、適用性、有用性などいかなる保証も行いません。当社は、いかなる理由によって本サービスの提供の遅延または中断などが発生しても、その結果会員または他の第三者が被った損害について一切の責任を負わないものとします。
当社は本サービスの利用により発生した会員の損害すべてに対し、いかなる責任をも負わないものとし、一切の損害賠償をする義務はないものとします。会員が本サービスの利用によって第三者に対して損害を与えた場合、会員は自己の費用と責任をもって解決し、当社に損害を与えることのないものとします。会員が本契約に反した行為によって当社に損害を与えた場合、当社は当該会員に対して相応の損害賠償の請求を行う事ができるものとします。
個人情報の取り扱いについて
当社はお客様からご提供いただいた個人情報の保護に関し、以下の取組みを実施いたしております。
当社は、個人情報に関する法令及びその他の規範を遵守し、お客様の大切な個人情報の保護に万全を尽くします。
当社は、ご提供いただいた個人情報については、下記の目的の範囲内で適正に取り扱いさせていただきます。
ご本人確認、及びご利用サービス提供条件の変更、ご利用サービスの停止の通知並びにその他当社サービスの提供に係ること
電話、電子メール、郵送等各種媒体により、当社のサービスに関する販売推奨
アンケート調査及び景品等の送付を行うこと
当社のサービスの改善又は新たなサービスの開発を行うこと
お問い合わせ、ご相談にお答えすること・なお、上記利用目的の他、サービス
アンケート等により個別に利用目的を定める場合があります。
当 社は、ご提供いただいた個人情報を適正に取扱うため、社内規程及び社内管理体制の整備、従業員の教育、並びに、個人情報への不正アクセスや個人情報の 紛失、破壊、改ざん及び漏洩等防止に関する適切な措置を行い、また、その見直しを継続して図ることにより、個人情報の保護に努めてまいります。
当社は、ご提供いただいた個人情報については、上記利用目的を達成するため、業務委託先又は提携先に預託する場合ございます。その場合は、個人情報の保護が十分に図られている企業を選定し、個人情報保護の契約を締結する等必要かつ適切な処置を実施いたします。 なお、法令等に基づき裁判所・警察機関などの公的機関から開示の要請があった場合については、当該公的機関に提供することがございます。
お客様が、お客様の個人情報の開示等をご希望される場合には、下記の当社窓口までご連絡いただければ合理的な範囲で速やかに対応いたします。なお、個人情報の開示等のご要望に対しては、所定の事務取扱手数料を申し受けます。
キャンセルについて
配送手続き完了後のキャンセルはお受けしておりませんのでご了承ください。配送手続き完了前のキャンセルにつきましては手数料$100になります。
返品について
配商品の品質には万全の注意を払っておりますが、初期不良や発送ミスの場合は修理もしくは交換をさせていただきます。それ以外の理由によるお取り替え・ご 返品には応じられませんので予めご了承ください。お客様の責任で破損、キズ、汚れが生じた商品や、商品の性質、相性を理由とした動作不良は初期不良とはな りませんので、ご了承ください。手数料等はご返金できませんので、予めご了承下さいませ。
保証期間について
保証期間につきましては、コンピュータの製造元の保証期間に基づきます。
モバイル機器でのご利用について
モバイルでご利用いただくための視聴環境をご用意ください。
iPhone、iPad、Androidスマートフォン、Androidタブレットでご利用の場合は、事前に専用の視聴アプリをApp Store、Androidマーケットにてご購入ください（有料アプリとなります。価格は変動しますので、購入先にてご確認ください）。視聴用アプリもつきましては、弊社でのご返金などはできませんのでご注意ください。
モバイル機器でのご利用では、インターネットや携帯、通信キャリア各社の回線を利用してデータを転送するため、各種通信料金が発生します。データの転送には大量のデータ （パケット）通信を伴うため、従量制プランでは高額のご請求が予想されます。定額プランにご加入されたうえでのご利用をおすすめいたします。なおWatchJTVモバイルソリューションご利用時のデータ（パケット）通信料金について、弊社は一切の責任を負いません。予めご了承ください。
モバイル機器でのアクセスはテレパソ１台につき２台迄となっております。（同時アクセス可能な台数）モバイル機器でテレパソにアクセスしますと大量のデータをエンコーディングすることになりますので、システムが録画中、ライブ視聴、データ転送中などと高稼働中にモバイル機器でアクセスされますとシステムのCPU稼働率が高まり録画処理に障害が起こる場合がございますのであらかじめご了承ください。モバイル機器での視聴にあたっては、Plexサーバーメンテナンス等の事情により一時的に利用できなくなる場合があります。予めご了承ください。
配布ソフトについての規約
“WatchJTV, Inc. will provide, upon request, source for software (Myth, Plex, OpenVPN) released under the GNU General Public License (GPL) or GNU Lesser General Public License (LGPL) that is installed on the PC, for a fee of US$10 + Shipping (Rates advertised on United States Postal Service website). The source code will be made available on a CD and will be mailed to the address you have provided.”
